    "body": "## 概况\n\n《导游管理办法》是规范导游执业的部门规章，由国家旅游局以第44号令公布。2017年10月16日经国家旅游局第17次局长办公会议审议通过，2017年11月1日公布，自2018年1月1日起施行。办法依据《中华人民共和国旅游法》《导游人员管理条例》和《旅行社条例》制定，取代2001年的《导游人员管理实施办法》。[^gov]\n\n## 主要内容\n\n办法对导游执业实行许可制度：从事导游执业活动的人员，应当取得导游人员资格证和导游证。国家旅游局建立导游等级考核制度、导游服务星级评价制度和全国旅游监管服务信息系统，各级旅游主管部门运用标准化、信息化手段对导游实施动态监管和服务。[^gov]\n\n执业规范方面，办法细化《旅游法》第三十五条的规定：导游不得擅自安排购物活动或者另行付费旅游项目；不得以隐瞒事实、提供虚假情况等方式，诱骗旅游者违背真实意愿参加购物活动或者另行付费旅游项目；不得获取购物场所、另行付费旅游项目等经营者以回扣、佣金、人头费或者奖励费等名义给予的不正当利益。[^gov]\n\n## 引用情况\n\n北京市文化和旅游局2026年导游素质提升线上培训通知引用本办法，作为导游培训与执业管理的依据文件。[^official]",
